Conference Call
2:00 p.m., March 27, 2007

Those participating in the conference call included Mark McDaniel, TCMA President and Deputy City Manager, Tyler; Mike Perez, TCMA President Elect and City Manager, McAllen; Paul Parker, TCMA Vice President and City Manager, Lufkin; Rickey Childers, TCMA Immediate Past President and City Manager, Lancaster; and Greg Vick, TML Board Representative and Assistant City Manager, Farmers Branch. Guest: James Fisher, Chair, TCMA Ethics Committee and City Administrator, Bee Cave. TML staff: Gary Watkins, Bennett Sandlin, and Kyle Jung.

Mark called the conference call to order and thanked everyone for participating.

James Fisher updated the Executive Committee about two ethics cases. Bennett Sandlin cautioned the TCMA Executive Committee to ensure the TCMA Ethics Code Rules of Procedure for Enforcement were followed in deciding ethics cases. On a motion by Mike Perez and seconded by Paul Parker, the Executive Committee asked James Fisher to contact the respondent to determine if the individual wished to continue their TCMA membership.

On a motion by Mike Perez and seconded by Paul Parker, the Executive Committee approved the recommendation of the TCMA Ethics Committee to Expel and Bar from future TCMA Membership, Israel Sagredo, former city manager of Alton, for his conviction of bribery and extortion.

Rickey Childers updated the Executive Committee regarding eligibility for candidacy for a statewide TCMA Board officer position. The finding of the TCMA Nominating Committee was that

an individual must be a permanent, full-time employee of a city in the position of City Manager/City Administrator or serving as the Assistant City Manager or Deputy City Manager or a permanent, full-time employee of a Council of Governments (COG) in the position of Executive Director or serving as the Assistant COG Director of Deputy COG Director, to be classified as a TCMA Full member. The person must meet these requirements to be eligible to run as a candidate for a statewide position on the TCMA Board. (February 20, 2007 TCMA Nominating Committee meeting)

Kyle Jung updated the Executive Committee about the scheduling of the TCMA sessions at the 2007 TML Annual Conference (scheduled for Friday, November 9, 2007 from 9:00-11:45 a.m. at the Dallas Convention Center).

Greg Vick informed the Executive Committee that with a 30 day deadline extension to submit nominations for the City Council of the Year Award, no nominations have been received. Mark McDaniel stated that the Executive Committee would make the selection of this award at a future conference call, to be held sometime before the June TCMA Annual Conference.

Mark McDaniel and Rickey Childers discussed with the Executive Committee the response from Frank Sturzl, TML Executive Director, regarding the proposed TCMA-TML Services Agreement. Mark McDaniel asked the Governance Task Force to review Frank Sturzl’s response and make a recommendation.

The TCMA Executive Committee meeting was adjourned at 2:50 p.m.
