BOARD OF DIRECTORS MEETING

FRIDAY, AUGUST 8, 2003

INTRODUCTORY ACTIVITIES

Those in attendance were: President Larry Gilley, City Manager, Abilene; President-Elect Craig Lonon, City Administrator, Conroe; Vice President Rickey Childers, City Manager, Longview; Region 1 Director Courtney Sharp, Assistant City Manager, Canyon; Region 3 Director Matthew Benoit, Assistant City Manager, Wichita Falls; Region 5 Director Jay Stokes, City Administrator, Jefferson; Region 6 Director Joe Dickson, City Manager, Santa Fe; Region 7 Director Bert Lumbreras, Assistant City Manager, Waco; Region 9 Director Charles Windwehen, Assistant City Manager, Victoria; Region 10 Director Mike Perez, City Manager, McAllen; Director-at-Large Karen Daly, Assistant City Manager, Longview; TML Board Representative Paul Parker, City Manager, Mount Pleasant; Immediate Past President Tom Muehlenbeck, City Manager, Plano. Staff: Frank Sturzl, Executive Director, Texas Municipal League; Gary Watkins, John Philpott, Gwena Cearley, and Kyle Jung.

President Larry Gilley called the meeting to order at 11:00 a.m. and welcomed the guests and members in attendance.

Frank Sturzl provided an update of the current status of the Texas State Legislature including the recently concluded regular session and first special session as well as an outlook for the second special session. Specifically, he mentioned 2H.B. 29 (Relating to the Date of Municipal Elections) and 2H.B. 9 (Relating to Stormwater Utility Fees). Also, the TML President will be asked to form an adhoc taskforce to look at the impact of the proposed school finance issue on Texas cities. Members of TCMA will be asked to serve on this taskforce when it is created.

On a motion by Tom Muehlenbeck and a second by Mike Perez, the Board excused the absence of John Gayle, Ed Thatcher, and Jack Hamlett.

Regional representatives updated the Board concerning regional activities and openings.

MEETING MINUTES

Upon a motion by Tom Muehlenbeck and a second from Joe Dickson, the Board approved the June 26, 2003 TCMA Board meeting minutes as presented.

MEMBERSHIP APPLICATIONS

Upon a motion by Mike Perez and a second from Craig Lonon, the following memberships were approved:

FISCAL YEAR 2003-04 TCMA AND FOUNDATION BUDGETS

The TCMA Budget Committee recommended the proposed FY 2003-04 Budget to the full TCMA Board. Kyle Jung was asked to provide a brief description of the highlights of the proposed TCMA and Texas Foundation for Local Government budgets. After a discussion of the proposed budgets, Craig Lonon moved and Bert Lumbreras seconded a motion to approve the FY 2003-04 TCMA Budget as presented and to recommend the Foundation Budget to the Foundation Board for approval. The TCMA Board approved the motion.

RECEIVE REPORT ON TML-RELATED ACTIVITIES

Paul Parker informed the TCMA Board that the TML Board approved its budget at the June 26, 2003 meeting. Frank Sturzl’s report covered other TML items relevant to TCMA.

OLD/NEW BUSINESS

Larry Gilley informed the Board that the Texas Fire Chiefs Association Board of Directors would like to hold a joint meeting on Friday, November 14.

As an additional opportunity for TCMA members to provide input into the upcoming strategic plan, there will be five regional strategic planning forums tentatively scheduled for September 12 (Corpus Christi), September 19 (Conroe), October 3, (DFW area), October 17 (Longview), and October 24 (Abilene). The TCMA Strategic Planning Retreat and Board meeting will be held Thursday and Friday, January 29-30, 2004 in Austin. Also, the TCMA Board will meet on Friday, April 23, 2004 in Austin and June 17, 2004 in South Padre Island. Details will be provided when available.

Kyle Jung provided proposals for the 2005 TCMA Annual Conference in Galveston to the TCMA Board. Upon a motion by Craig Lonon and a second by Mike Perez, the TCMA Board awarded the 2005 TCMA Annual Conference to Moody Gardens (June 10-13, 2005). The TCMA Board’s decision was based on three issues: first, the rate of the sleeping rooms (same in 2005 as in 2000); second, the entire conference will be contained in a single property; and third, the positive feedback provided by TCMA members of the experience during the 2000 TCMA Annual Conference at Moody Gardens.

Larry Gilley reminded the TCMA Board of the TCMA Code of Ethics and the Rules of Procedures to begin an official investigation by the TCMA Ethics Committee of an alleged violation of the TCMA Code of Ethics. Specifically, a written complaint indicating what activities occurred and which tenet of the TCMA Code was broken must be submitted.

Craig Lonon, Chair of the TCMA Ethics Committee, expressed his concern regarding several newspaper articles about Texas city managers. No other action or discussion was taken regarding these news stories.

ADJOURNMENT

There being no further business, the TCMA Board adjourned at 1:10 p.m.

TEXAS FOUNDATION FOR LOCAL GOVERNMENT

The Foundation Board was called to order at 1:15 p.m. on Friday, August 8, 2003. In attendance were Board members: President Larry Gilley, City Manager, Abilene; Craig Lonon, City Administrator, Conroe; Rickey Childers, City Manager, Longview; Paul Parker, City Manager, Mount Pleasant, and Kyle Jung, TML staff.

The only item on the agenda was the approval of the FY 2003-2004 Texas Foundation for Local Government Budget. On a motion by Craig Lonon and a second by Rickey Childers, the Board approved the FY 2003-04 Budget as presented.

There being no further business, the Foundation Board adjourned at 1:20 p.m.
