INTRODUCTORY ACTIVITIES

Those in attendance were: TCMA Board Members: President Courtney Sharp, City Manager, Midland; President-Elect Bill Keffler, City Manager, Richardson; Vice President David Landis, City Manager, Perryton; TML Board Representative Jim Jeffers, City Manager, Nacogdoches; Immediate Past President Paul Parker, City Manager, Lufkin; Region 1 Director Colby Waters, City Manager, Canadian; Region 3 Director David Vela, Assistant City Manager, Abilene; Region 4 Director Julie Couch, City Manager, Rockwall; Region 5 Director Jeff Howell, City Manager, Kilgore; Region 7 Director Ed Broussard, City Manager, Hutto; Region 8 Director David Harris, Assistant City Manager, Schertz; Region 9 Director Michael Kovacs, City Manager, Port Aransas; Region 10 Director Wendy Smith, Assistant City Manager, McAllen; Director-at-Large Julie Johnston, City Administrator, Dickinson; Representative of the Assistants’ Organizations Jeffrey Trinker, Management Assistant I, Sugar Land. President Courtney Sharp called the meeting to order at 9:00 a.m. and welcomed those in attendance. Regional representatives updated the Board concerning regional activities and openings.

On a motion by David Harris and a second by Julie Johnston, the Board excused the absences of Rick Osburn and Modesto Mundo.

MEETING MINUTES

On a motion by Jim Jeffers and a second by David Harris, the Board approved the June 4, 2009, TCMA Board meeting minutes as presented.

On a motion by David Harris and a second by Julie Couch, the following new memberships were approved:

RECEIVE REPORTS FROM TCMA COMMITTEES

Courtney Sharp, chair, TCMA Executive Committee, informed the Board that the committee has not met since the last TCMA Board meeting.

Bill Keffler, chair, TCMA Professional Development Committee, updated the Board about the TCMA Professional Development Committee meeting in Galveston on August 13-14, 2009, and the development of the programs for the TCMA educational events.

Jim Jeffers, chair, TCMA Communications Committee, informed the Board that the committee has not met since the last TCMA Board meeting.

David Landis, chair, TCMA Membership Committee, informed the Board that the committee’s first meeting is scheduled for September 25, 2009, at Love Field in Dallas.

Paul Parker, chair, TCMA Nominating Committee, informed the Board that the committee has not met since the last TCMA Board meeting.

Julie Couch, chair, TCMA Ethics Committee, updated the Board about two ethics cases the committee reviewed and their recommendations to the TCMA Board. Jim Jeffers moved and Julie Couch seconded a motion to publicly censure a TCMA member for violating Tenets 2 and 3 of the TCMA Code of Ethics. The motion failed on a 5 to 8 vote. On a motion by Wendy Smith and a second by Paul Parker, the Board voted to privately censure a TCMA member for violating Tenets 2 and 3 of the TCMA Code of Ethics. The motion was approved on a 14 to 1 vote, with Julie Johnston voting against.

On a motion by Jeff Howell and a second by Julie Johnston, the Board voted to publicly censure and expel Joseph Painter, city manager, Castroville, from membership in TCMA for violating Tenet 7 of the TCMA Code of Ethics. The motion was approved on a 14 to 1 vote, with David Harris voting against.

The TCMA Board asked Tom Muehlenbeck if he would discuss the possibility of ICMA postponing the release of their ethics case decisions regarding individuals who are both TCMA and ICMA members so that a joint notification can be made by TCMA and ICMA.

RECEIVE REPORT ON TML-RELATED ISSUES

Jim Jeffers, TML Board representative, informed the TCMA Board that there was nothing to report on TML-related issues at this time.

RECEIVE REPORT ON ICMA-RELATED ISSUES

ICMA Vice President Tom Muehlenbeck updated the TCMA Board about the following items: the revised PM magazine format; the current representatives from the ICMA mountain-plains region on the ICMA Board; the estimated financial loss of the ICMA Annual Conference in Montreal; and the ICMA Board’s decision to hold the 2017 ICMA Annual Conference in San Antonio.

RECEIVE REPORT ON ASSISTANTS-RELATED ISSUES

Jeffrey Trinker, assistant organizations representative, updated the Board on recent activities of the statewide assistant organizations.

2009-2010 TCMA STRATEGIC PLAN

On a motion by Jim Jeffers and a second by David Landis, the Board approved the 2009-2010 TCMA strategic plan as presented.

2009-2010 TCMA AND TEXAS FOUNDATION FOR LOCAL GOVERNMENT BUDGETS

The TCMA Budget and Planning Committee submitted proposed budgets for TCMA and the Texas Foundation for Local Government (TFLG). On a motion by David Harris and a second by Julie Couch, the TCMA Board approved the 2009-2010 TCMA budget as presented. On a motion by Paul Parker and a second by David Harris, the TCMA Board recommended that the TFLG Board approve its budget as presented.

The TCMA Board asked Kyle Jung to contact TCG to determine if the flat rate cost to TCMA could be renegotiated so that it would possibly be based on utilization instead of a flat fee.

OLD/NEW BUSINESS

The TCMA Board reviewed the revised TCMA Board job descriptions. Julie Johnston expressed concerns about the proposed duties of the director-at-large position, and Jim Jeffers expressed concerns about proposed duties of the TML Board representative. On a motion by Julie Johnston and a second by Julie Couch, the TCMA Board approved the revised TCMA Board job descriptions as presented with the exception of the director-at-large and TML Board representative descriptions which will be brought up at a future TCMA Board meeting.

On a motion by Jim Jeffers and a second by Julie Couch, the TCMA Board determined there was no need for the TCMA Communications Committee to continue and abolished it. Notification to the committee members will be sent the week of August 31.

The creation of a TCMA Legislative Committee was discussed during the development of the 2009-2010 TCMA strategic plan. Jim Jeffers moved to create the TCMA Legislative Committee with the TML Board representative appointed as the chair. With no second from the Board, Jim Jeffers withdrew his motion and stated that he would talk with Frank Sturzl, TML executive director, and bring this issue back to the TCMA Board at its next meeting.

On a motion by Bill Keffler and a second by Paul Parker, the TCMA Board approved the creation of the TCMA Legacy Leaders Task Force. This task force will expire on June 29, 2010, and it will coordinate the development of the TCMA Legacy Leaders program. Tom Muehlenbeck will be the chair, and Ron Whitehead will be the vice chair of the task force.

ADJOURNMENT

With no other business, the meeting was adjourned at 11:24 a.m.

TEXAS FOUNDATION FOR LOCAL GOVERNMENT (TFLG)

The Board called the meeting to order at 11:24 a.m. and in attendance were Courtney Sharp, Foundation president; Bill Keffler, Board member; David Landis, Board member; Jim Jeffers, Board member; Paul Parker, Board member; members of the TCMA Board; and Kyle J. Jung, TML staff.

On a motion by Paul Parker and a second by Jim Jeffers, the Board approved the 2009-2010 TFLG budget as presented.

There being no other business, the Foundation Board adjourned the meeting at 11:25 a.m.

January 29, 2010, at the Texas Municipal Center, third floor conference room, in Austin
March/April 2010, in Midland (TBD by Courtney Sharp)
June 24, 2010, in Galveston (prior to the TCMA Annual Conference)
